    Hello to all you helpful people,

    I would appreciate your comments on the following situation:

    I have had dealings in the past with the above, however all has gone quiet until yesterday when I received no less than 6 phone calls in the space of an hour.

    Having checked my credit report the debts that they are chasing are due to become statute barred in a couple of months.

    Are they just trying to get me to pay a nominal amount so that the 6 years will start again?

    Very likely they are trying to reset the clock! Don't speak to them, if you answer the phone, refuse to go through security and hang up.

    Your credit report is not an accurate indicator of Statute Barred status, the OFT guidelines state defaults should be recorded between 3 and 6 months after your first missed contractual payment, some leave it even later than that, which means a debt could be SBd before it drops off your credit file. On the other hand, if you made payments, even £1/month tokens, the debt would be live long after it drops off. Do you know when you last paid this?

      Or repeat everything they say, v-e-r-y s-l-o-w-l-y and putting some words in the order wrong - until they hang up!

        Have just looked at my credit file and both debts are approaching 6 years, one at the end of this month, the other in July.

        Have missed 4 calls so far today but I do feel in control of the situation, thanks to you.

          Good to hear you're feeling in control. :thumb:

          Do bear in mind what I mentioned on post 2 above, the dates on your credit file are NOT the same as the dates when you stopped paying. If you defaulted and never made any payments, the one that's due to drop off at the end of this month is probably already SBd, as your last payment would have been a few months earlier than the default. SBd is from when you last paid (or acknowledged in writing), not from the date the default was recorded.

            They're probably both SB.

              Baring in mind that this only applies if the account has been terminated, otherwise it will be the termination date, as it is the cause of action.
