  • Cabot/Citifinancial Card Debt Not Mine

    Hi
    I started receiving letters about a credit card balance that this company claim I owe them. The account, apparently, defaulted in 2004. I've had letters sent to a previous address & I more or less ignored them. My wife persuaded me to contact this company & confront them, which I did. They insist I used a card of theirs, and they then passed the debt to Ruthbridge's (debt collectors). I contacted Ruthbridges last November and told them it wasn't my debt, and they advised me to request a proof of signature, which I did. I didn't get a response, so I contacted them again & they confirmed they had received the request, which they'd forwarded to Citifinancial, and said it may take up to a couple of moths for a response from them. Today I received a demand from a different company, Scotcall, who are ' the UK's leading doorstep recovery company'(for the same 'debt'). I 'phoned them and they advised me to contact the police, which I did ( I now realise I should've done this sooner, head in sand, and all that). They have advised me to check on Experian, which I've done, and contact citifinancial. My head is now well and truly spinning (no doubt yours will be too, if you're still reading). Help please, what should I do??

    first of all dont panic, it's not yor debt you can't be made to pay it. If the last payment or cknowledgement of the debt was 2004 then it isstatute barred. which means ou can't get taken to court over it and the recordsghouldhave dropped off your credit record. It would be a good idea to check experian . More knowedeable people will be along shotly to advise you better .

      The debt should be statute barred if no payment or acknowledgement has been made on the account for the last six years.
      The DCA should not be pursuing a debt that is statute barred.

      i am sure that there is a SB letter template on here somewhere for you to send , if not i will put one on here for you.

        Thanks Seduraed, I'm glad I joined this forum already
        I checked on Experian and there's no record of this 'debt' but there's an unrecorded search done April 2011 by this company (Cabot) how can they search my financial records without my permission? (sorry, another question)
