    Re: Cabots (again!!)

    Thanks again Labman

Will give a try over the next day or so and keep everyone posted as to how we get on.

Am prepared for a battle but these companies need to know they cannot get away with some of the tricks they try to pull

Its amazing thay they are still using the same tactics.
All they supplied to me were templates of letters with no details on them that could have been for any one!

        Yep!

And when challenged they decide to back the lemon to the OC...

Checking the credit file have no found that Cabots ran a credit check back in 2010.

What the heck is all that about?!!!

Anyway have printed off the form for the ICO so here goes

            Re: Cabots (again!!)

So sent yet another SAR letter with a £1 postal order

            Today received this from Cabot

"we have requested the relevant documentation from Goldfish, however we have been informed that they are unable to provide the required information. I have therefore returned your £1 fee.

Therefore, I can confirm that Cabot has taken the decision to no longer pursue collection of this account"

They then go on to say that this should not be interpreted as a write off of the account, that the debt remains and they can still report to CRAs

This has left me a little confused. Are they admiting, but not in so many words, that all they have is equitable assignment? If so, the DN they have filed is not lawful and I have to try and get them to remove it? Also the credit search they have done cannot be right either. What reason do they have to perform a credit search?

            Anyone got any ideas?

              Re: Cabots (again!!)

It seems common practice for them to return the £1 they did to me twice so I am wondering if any one can tell us if this is right I thought that they had to accept this legally.
