  • Debt with Cabot Financial - Everything is a mess and I need some advice please

    Hi there,

I've not had a CCJ to be clear, but I couldn't see another Cabot specific forum, so apologies if this wound up in the wrong place, I'm new here.

To give some history, I had a well-managed personal debt with Natwest that was acquired in 2011. The payments were a little high with the cost of living going up so I applied for an IVA in 2013. I was accepted. Sadly, the same day I also got made redundant. After about six months of an IVA freeze, and two months of phoning the IVA people to no avail, I defaulted on the IVA due to that one missed payment outside of the freeze. This is the only default I've had in my entire life.

The debt was then passed to Apex Credit Management, who I never missed a payment with. I also dimly recall letters from someone called "Marlin Group".

For context here, Marlin Group were sold to Cabot in 2014. Also, Apex Credit Management and Cabot Financial merged in 2011 in some way. Cabot tell me that Apex and Marlin "ceased trading", but their Companies House suggests they're very much alive and well and even filed their usual confirmation statements, so who knows. I only mention this because I think it caused some weird crossover in the name on my bank statements and their records overall.

So, here's where it all gets a bit... confusing.

My historical bank statements dating back to November 2017 (far back as I could go) show that up to around Feb 2018 I was paying Apex Credit. Then in April 2018, Cabot appear to have taken over.

My online Cabot account shows no statements prior to April 2019, however.

I can't find a lick about Marlin, but it may be that it was just too long ago.

Two people have told me on the phone that Cabot did not buy the debt from anyone. One person told me I 'defaulted' and they took the debt in 2018. Impossible, as I defaulted in 2013. They seem to have a big fat black hole in what was happening during that time.

However, they also claim that Apex is not them and the money did not go to them (this is just blatantly untrue, if you search for an old web page of Apex's phone number, it goes through to Cabot).

In brief, I am going to see if I can request my CCA, because I have had it with this debt. I need to know it's unenforceable so I can just get it off my back. I don't care much about credit - not planning on using my credit any time in the far foreseeable future.

Just wondering if anyone else has had such a nightmare? I don't even truly know who to ask for my CCA. Is it Cabot? Do I now go to Apex or Marlin? My original Natwest bank??
