Complained to Cabot now they have found a reconstituted CCA

  • Complained to Cabot now they have found a reconstituted CCA

    So I will be brief Cabot threatened legal action on a default Westcott passed to them in December last year, I asked for copy of agreement, they could not find.

    So I complained about there tactics, remarkably on the last day of the 8 weeks they have they provided a reconstituted agreement which is attached, there is no date or CC limit just my old address with name (Sadly it wont let me upload?) would this be accepted in a court, Also they wrote on the 4th May to acknowledge my letter and on the 31st to say they are still looking into, yet the CCA and statement of account both show a date of the 4th May.

    I am complaining to the FCA over them but wondered where i stood with this as their is no date nor credit limit, and i wouldn't put it past them to just do this because i complained

    When did you open the account?

    It should have the following 'date, CC limit', they should also provide agreements if the APR has been 'varied'.

    Write to them, include the following 'The Failure to Comply', state that as they have not complied you will lodge a complaint with the FCA.

    Make sure you get Proof of Postage. Wait for their response, it should be one that says 'until we can provide the requested documentation, then the debt is 'unenforceable'.
