  • CCJ Consent removal after paying

    Hello,

I have two CCJ’s on my file, from 2018 and 2019, one with Cabot. At the time I had moved home, multiple times in a short few years and I had no court paperwork for both. I was unaware about the CCJ until I had checked my credit report and done a bit of digging. I had a very messy past, and once I was aware of the CCJ, I made payment 01.2022 in full. Now having issues with credit, and I fully suspect it’s from the CCJs, and my “messy” past, however that is all 2018 and I have sorted my time out from then. I since have checked online and I have read posts about not getting the court papers, you could have it set aside.

I fully admit to the debt, this will be mine, and once I found out I had the debt, I made payment as soon as I could. I have checked I have some other options, such as CCJ Consent order, to have the CCJ removed from my file.

Has anyone had experience with this, I have checked there is plenty of law firms that say they will help with this, however none have a fee and all want you to call them. What are the chances, and does it require a solicitor, could I write to Cabot.

I don’t want any money back, I owed this. I just would like to repair my credit report as it is having a detrimental affect now on future prospects, and also putting my job at risk now.

    Any advice would be amazing,

    Jamie

Hi Jamie, while I can't offer legal advice, here are some general insights based on your situation:

      1. Consider seeking legal advice: Consulting a solicitor specializing in CCJs might be helpful, especially since you haven't received court papers. They can assess your specific circumstances and guide you on the best course of action, including:
      • Exploring the possibility of setting aside the CCJs: This approach attempts to have the CCJs removed due to not receiving court papers.
      • Negotiating with Cabot: A solicitor could potentially negotiate with Cabot to have the CCJs removed from your credit report after full payment, considering the circumstances.

      2. Contact Cabot directly: While a solicitor might be beneficial, you can also try:
      • Explaining your situation: Contacting Cabot directly and explaining your circumstances (not receiving court papers, immediate payment upon awareness) might lead them to consider removing the CCJs from your credit report.
      • Negotiating a Consent Order: This is a formal agreement with Cabot, potentially acknowledging the debt and its full payment, leading to them removing the CCJ information from credit bureaus after a set period.
