  • Cabot finance/ northern rock unsecured loan.

    Hi,

    I’m after some advice. I had an unsecured loan with northern rock years ago that was in my name, I was sharing a mortgage with my ex partner and we broke up, I left the property and stopped paying the loan and the mortgage as the ex refused to sell.
    The loan was then charged against the house. Then northern Rock went under and I was moving from different addresses for work and didn’t really think or care about the debt. I was young at the time. I have no letters or anything about a ccj as I was constantly on the move. Fast forward 18-19 years I’m settled with a family and am now getting constant letters and text from Cabot financial. Cabot have passed the debt on to 2 different collection agency who I ignored and they passed the debt back to Cabot. My credit score is 900+ and my file obviously doesn’t show any ccj as it was that long ago. Can I keep ignoring this debt or should I pay Cabot even tho there is a charging order on a property that I no longer live at or have anything to do with but am actually still on the mortgage. The loan was large and I don’t really want to disclose the amount.

    I appreciate how messy this is but would really appreciate any advice.

    Above all do nothing to resurrect a debt.

      S20 Limitation Act 1980 may be helpful:

      20. Time limit for actions to recover money secured by a mortgage or charge or to recover proceeds of the sale of land.

      (1)No action shall be brought to recover—

      (a)any principal sum of money secured by a mortgage or other charge on property (whether real or personal); or

      (b)proceeds of the sale of land;

      after the expiration of twelve years from the date on which the right to receive the money accrued.

      More information would be helpful. Has the house in question been sold, and if so when?

        My ex partner still lives in the house and pays the mortgage. She has no plans on selling it anytime soon.
