Hi - I recently agreed to settle out of court in a claim against a builder - I was the claimant - it was agreed that the defendant would pay me a sum of money by a certain date - the defendant’s solicitor advised it was called a Tomlin Order.
The judgment paperwork from the court is titled “General form of judgment or Order”.
My question is how do I enforce the order if the defendant breaches it? (The date set in the judgment to pay the money by is fast approaching)
Is there a form I need to complete? (I saw something online about a D11 form but that seems specific to divorce cases)
Any practical advice is greatly appreciated.
