  • Advise Please - CCJ by Cabot

    Hi

    Looking for some advise as to what I can do regarding a CCJ by Cabot.

    I had a CCJ placed on my credit file by Cabot in 2004. They then got a Charging Order on my property after disputing the debts and the amounts for months I gave in and remortgaged and paid the outstanding debts to Cabot in 2007. I then found this site and decided to look into the debt further I requested the cca's from Cabot the CCJ/Charging Order was made up of 2 debts 1 from HFC and 1 from Citi Cards.

    I received a credit agreement regarding the HFC debt but Cabot stated they have no agreement for Citi and that Citi have no agreement.

    They sent a couple of statements and stated that this was evidence enough.

    I have since Subject Access Request'd Cabot, HFC and Citi.

    The Subject Access Request from HFC reveals approx £5000.00 difference in the amount outstanding from HFC and what Cabot charged me.

    The Subject Access Request from Cabot does not show any charges or interest added to the HFC debt.

    Nothing received from Citi they state they have no trace of me.

    My questions are

    1. can I request the money I paid to Cabot regarding the Citi debt back??

    2. can I dispute the CCJ and apply to have it set aside as this was made of the 2 debts and they had no cca for the Citi debt.

    3. what can I do about the big difference in the debt sold to Cabot and what I actually paid to them.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
