  • Mortimer Clarke ccj claim

    Hi. I have received*a county court claim form. This is from Mortimer Clarke solicitors on behalf of Cabot Financial regarding a vanquis credit card from 2013. I acknowledge that I had the credit card but I don’t agree with the amount they are claiming. Around 2016 the debt was passed to another debt collecting company and I made several payments £100 each towards the debt. These payments don’t appear to have been taken off the total amount and also there is no mention on the claim form of the other company that I paid before the debt was passed to Cabot. I would be grateful of any advice on how to precede with this. I was thinking of writing and asking for CCA? Many thanks

      Hi - welcome to LegalBeagles.
      Firstly, have you acknowledged the claim online? Follow the shortcut links in the column on the right. You must do this immediately.
      Also follow the request for information steps: send off a CCA request to receive a copy of the original agreement & statement of account, CPR 31.14 etc.
      Do you have copies of any transactions of payments you made. What company did you make those payments to? Also a Subject Access Request to the original creditor would show what the balance was when it was assigned.
