    Hi, new to this forum and looking for some help.

    My now wife took out a fixed sum loan agreement in 2007 (before we met) which was secured on her property. The loan was for £7500 before fees and interest a total of £15635.52.

    Her house was repossessed by the mortgage company (GE MONEY) about 5 yes ago and was sold at auction I believe.

    Apart from a couple of letters from ascent legal a couple of months ago saying they wanted the amount of £7798 which we sent statute barred letter in response too the only response we have had back is a letter dated 29/07/2014 stating that Welcome Finance was sold to Cabot Financial (UK) who have appointed Marlin Financial Services as the managing agent of the account. Attached to this was also a letter from CabotFinancial dated 26/04/2016
    Saying that they asked Ascent legal to manage the account.

    They have also included what seems to be a photocopy of the original Fixed Sum Loan Agreement regulated by the Consumer Credit Act 1974 secured on the property she owned at the time.

    The house was repossessed about 5 yes ago and we have had nothing from either the mortgage company or the finance company until this a couple of months ago. We have contacted the mortgage company to find out how much the house was sold for to work out if the balance on the mortgage plus the secured loan would of been covered but the mortgage company say they can't find any details of the mortgage!

    How do we stand on this?

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
