  • Nolan’s - proposal for affordable repayment

    hi guys

    I have recieved a letter from Nolan’s solicitors on behalf of ME III Limited. The letter says I am due a balance of £11,200. But I have no idea what this is for and concerned how I should be managing this as the letter is asking about my affordability and threatening “necessary litigation or enforcement action” if I do not respond within 14 days.

    Any advice on next steps would be greatly appreciated.

    From reading on here I believe I should be completing a CCA request but given I don’t know what this is for I am not 100% certain that is the correct action to be taking at this point.

    you owe that amount they allege,, do you have outstanding amounts to credit card/loan etc?

      This is a fairly typical response in my experience. On one argument if this means nothing to you it could just be ignored; however there is a better way to deal with it. Which part of Scotland are you based?

        Nope I dont have any credit cards or loans that are outstanding so not sure how I can be due money that I am not aware of ever having espically to that amount.

          Does the letter say nothing about the original debt ?

          Anything at all on your credit file ?

          A SAR https://legalbeagles.info/library/gu...etter-example/ and a CCA request https://legalbeagles.info/library/gu...etter-example/ to MEIII and copied to Nolan's for their information, telling them you have no idea what the debt is and request they put things on hold whilst you find out more information.... You could ring MEIII or Cabot (https://help.cabotfinancial.co.uk/s/...language=en_US ) to try find out what it is - making an enquiry isnt acknowledging a debt if there are stat barring issues. Once you know what it is you can contact the original creditor if you still don't recognise it or send them a SAR.

          It could be a tracing/mistaken identity error or it could be a genuine old debt that has been forgotten - last thing you want is a judgment for it.

            The letter has no detail about the debt at all just that it’s from ME III and the amount the rest of the paperwork is about affordability. This is also the first letter I have received on this.

            I have also checked my credit file and there is nothing on that either.

              Could be some tracing / address error - or even an identity theft issue - you would remember the odd £11k outstanding I suspect. Let us know when you find anything out.
