To cut a long story short I have been trying to defend a claim for an old Tesco loan that Cabot Financial have since taken on.
I did the usual CPR request and at the time I submitted my defence I had no reply so this was the basic grounds of my defence and the claim was stayed.
Since then the stay has been lifted and Cabot Financial have sent me copies of my original loan agreement with my signature along with various other paperwork. In fairness it all looks in order.
Today I have received a letter advising if I don't respond offering a repayment plan by 1st August at 4pm they will apply to the court for a summary judgement.
My question is - what is a summary judgement? Is it possible the court can issue me with a CCJ without me being able to change my defence?
