    This one started in 2006 whilst I was on another site. Bear with me as I seem to have some of the paperwork missing will post it up as and when I find it all.

    But here's whats happened so far roughly:

    Got the usual threatening letters from Cabot ie you owe us etc etc during the course of 2005/6 until I found and joined on site.
    Sent the 'old' CCA 1974 request on 1 Nov 2007 the 12 + 30 days were up on 13 Dec 2006

    I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.
    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 cheques in payment of the statutory fee, Serial Number 000125 .
    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.
    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
    Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.

    Can'd find any paperwork now till I sent this, the second letter on 19 April 2006

    I refer to my letter dated 1st November 2006 which was delivered via recorded delivery to your offices on 3rd November 2006.
    In my letter I made a formal request for a copy of the signed, fully executed credit agreement for the above numbered Barclaycard account under section 77(1) and section 78(1) of the Consumer Credit Act. In addition a statement of my account should have been sent along with any other document mentioned in the credit agreement.
    The Consumer Credit Act allows 12 working days for this request to be carried out before your company enter into a default situation. If the request is not satisfied after a further 30 calendar days, your company commits an offence. These time limits expired on 13th November 2006 and 13th December 2006 respectively.
    As you are no doubt aware subsection (6) states:
    If the credit under an agreement fails to comply with subsection (1) -
    (a) He is not entitled, whilst the default continues, to enforce the agreement; and
    (b) If the default continues for one month he commits an offence.
    Therefore as at 13th December 2006 this account became unenforceable at law and it is now my intention to refer this matter to the enforcement authorities.

    Now I do have some replies etc somewhere but can't seem to find them but I seem to remember that they say 'we are looking for your paperwork and everything is on hold till will find it' etc etc

    So now up till today more or less

    I have received this list of papers:

    A copy of Barclaycard application form all duly signed and dated by myself,
    5 pages of copy statements
    A copy of the Credit Agreement with no signature nothing on it apart from what looks like the bottom half of someones writing of 2002/3/4/ whatever
    Copy of notice of assignment from Barclaycard to Cabot
    Copy of letter from Cabot saying that the debt had been purchased by Cabot Financial Group Ltd, with 2nd page entitled additional information.
    and a what look like a statement of account with just a list of my payment on the account and the balances.

    Obviously I can scan these in if needed.

    My question is (yes I know I should probably know the answer already) but is this enforceable after all this time.

      There's a 95% chance this would make a good aeroplane

      B'card are #2 after Cap1 for their lack of enforceable "agreements".

      If you could scan the signed document as anything else is completely worthless.

            So are you saying (in english please) that its basically a load of waste paper and is still non-enforecable ?

            If so do I write and tell them or shall I just let them stew in their own juices?

                  Last letter dated 12 August 2008, came with the paperwork supplied this is what it says:

                  Information under the Consumer Credit Act
                  Further to you request for information under the Consumer Credit Act, we are pleased to enclose with this letter all the relevant information.
                  What does this mean?
                  Cabot and the original lender have now completed the relevant obligations under the Consumer Credit Act. As a result, Cabot is entitled to resume collections of the outstanding balance of £3980.73 (a)
                  In the even that you wish to clarify or query anything related to the enclosed information, please do not hesitate to contact us and one of our helpful customer advisors will be pleased to assist you.
                  Independant Advice
                  If you are querying any part of the information provided to you by Cabot which you have not yet been able to clarify with us, we recommend that you seek independent legal advice.
                  Contacting Cabot
                  If you have any queries about your account or payment options etc etc


                  Now this is weird on the side of the letter it says:

                  You currently owe £4944.50 but in the main body of the letter it quotes (a) funny eh, or am I missing something.

                      Okies here's an attempt at replying to these numpties, feel free to add/adjust whatever guys, as you all know my grammar is not that great (eh Amy hun).

                      Dear Sir/Madam,

                      Thank you for your letter dated 12 August 2008 the contents of which I note.

                      In your letter you state that you have enclosed all the relevant information that was requested under the Consumer Credit Act, in fact all you have supplied is a copy of an Application Form and NOTE a true copy of the Agreement as is required under the Consumer Credit Act.

                      Therefore I submit to you that the debt is still unenforceable and will remain so until you suppy a true signed copy of the Agreement.

                      Nice Try Guys!!!!!!!!!!!!!! Keep them coming.

                        Letter before Action

                        Dear Sir/Madam,

                        With reference to my previous letters, I wish to draw you attention to your company's lack of compliance with my legal request.

                        On **DATE** I made a formal request for a true signed agreement for the alleged account under consumer credit Act 1974 s77/8. A copy of which is enclosed for your perusal and ease of reference.
                        You have failed to comply with my request, and as such the account entered default on **DATE**.

                        The document that you are obliged to send me is a true copy of the executed agreement that contained all of the prescribed terms, all other required terms and statutory notices and was signed by both your company and myself as defined in section 61(1) of CCA 74 and subsequent Statutory Instruments. If the executed agreement contained any reference to any other document, you are also obliged to send me a copy of that document.

                        As you may not be aware , failure to comply with this request within 12 working days renders the alleged debt UNENFORCEABLE in law. Furthermore, if this non-compliance continues for a further month then a summary, criminal offence is committed.

                        Furthermore you should be aware that a creditor is not permitted to take ANY action against an account whilst it remains in dispute.

                        The lack of a compliant credit agreement is a very clear dispute and as such the following applies.

                        * may not demand any payment on the account, nor am I obliged to offer any payment to you.
                        * may not add further interest or any charges to the account.
                        * may not pass the account to a third party.
                        * may not register any information in respect of the account with any credit reference agency.
                        * may not issue a default notice related to the account.

                        Therefore this account has become unenforceable at law.

                        Consequentially any legal action you pursue will be averred as both UNLAWFUL and VEXATIOUS.

                        After taking advice, I am of the opinion that your continued pursuit is in violation of the Administration of Justice Act 1970 section 40, Protection from harassment Act 1997 section 3 as well as breaching a number of the OFT Collection Guidelines.

                        I reserve the right to report your actions to any such regulatory authorities as I see fit.
                        You have 14 days from receiving this letter to contact me with your intentions to resolve this matter which is now a formal complaint.

                        I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you would prefer to do this than merely respond with standard letters and leaflets.

                        I would appreciate your due diligence in this matter.

                        I await your rapid response.

                          Oh I just love a clever letter, thanks for that hun, copy printed and in envelope for tonights post already.

                          Lets see what they come back with after that, if anything ! msl:

                          Just a small point in the letter it say I enclose a copy of the Act, have you seen a copy laying about anywhere to save me going hunting.
