    Hello All, this is my first post here so sorry if I've posted in the wrong section.

    I'm Regional Sales Manager for a Foodservice company, and we have found that a former employee of ours has been selling customer data including contact details, pricing structures, credit terms and any rebates that are offered to them to competing firms.

    We are looking to take action to ensure this does not continue to occur, and I am just wondering if anybody can advise informally as to whether or not this itself is illegal, under what law and if we are able to stop it occurring ongoing.

    Hi,
    Welcome to the Beagles.

    Can I just confirm, the employee was selling CUSTOMER data, i.e who they were, discounts etc or were they selling company data i.e costs of products and services and available discounts (2 totally separate things).

    If they are selling customer information, this is a potential breach of DPA and is incredibly serious, not only for you but for the employee too!!

    a bit long winded but I find it easier to understand than the Act itself.

    My basic understanding is that if this data is sold without knowledge or consent it is a breach of data protection!

      If your customer's are retail outlets and thus businesses, then it wouldn't be covered under the DPA, but it would be a major breach of trust and confidence between the employer and employee - and the firm could look at taking disciplinary action against the employee and possibly an injunction against him for continuing to sell confidential trade data.

      Does the employment contract contain a specific confidentiality clause at all ?
