    Im a claimant with a case that was due to be heard last week. The order required documents to be produced by early Jan, which I complied with. The defendant on the day the papers were due requested an adjournment, so did not file their papers, and some three weeks produced some hospital appointments letters and formally requested an adjournment. The court accepted the adjournment and has set a new date, and a new date for filing papers.

    1. Can I submit more info, even through I have filed ?
    2. I have documentation that proves the defendant was undertaking manual work on the day the case was suppose to be heard. Should I tell the court, or rise above it ?

    I think you could have a hospital appointment and do manual work on the same day so I would rise above it.

    Yes you could submit additional documents if they are directly relevant - I'd resubmit your whole bundle to replace the original and supersede it ''in compliance with the new order''. So long as you aren't changing any facts from your witness statement and purely adding further information.

      The "main" reason for the adjournment was due to a "operation" - this was day surgery three days before court case. They wanted 8 weeks to recover , the judge gave them two weeks ( so I assume saw through this). I just think it makes a mockery of the system, when I have filed all my documents to them, and they are just stalling. I wanted the Judge to see that the "operation" was just stalling and the defendent was in fact fit and well on the day the case was suppose.

        HI, The defendant had a order to produce documents by 4.00pm today, nothing in the post, and only one hour left, Can they deliver the documents to my home address ? Do I have to accept them? I did request that they did not contact me, and that all correspondence was in writing after they starting lashing out insults to me.
