  • Small Claims Court - Defendant not in the UK - EU

    Hi Everyone,

Hopefully this is the correct area to ask this question.

I've raised a claim (Moneyclaim online) against a person who I advanced money too (loan agreement agreed).

Without going into much detail I have a query I'm hopeful you can help me with.

The loan amount was agreed in the UK and the person I am claiming from is a UK resident with a residential property.

He has since moved to Ireland (not NI) and even though I know his residence is in the UK, as he flys regularly, could this be a sticking point for me with my claim i.e. he tries to claim he lives in Ireland?.

If this is the case does anyone know my rights on the claim I have placed with the UK Claims process.

    Thanks for all your help.
