    Hi Can I have some advice on bringing a civil court claim for sexual assault, grooming, coercive control, victim intimidation, bullying, defamation, data protection breaches. Malicious police reports were made too.

    Which laws/acts needed to bring the case under?

    Sexual assaults would come under trespass to the person
    Would grooming, coercive control, victim intimidation, bullying comer under protection from harassment act? also intentional infliction of harm (Wilkinson v Downton (1897))?

    Is there anything for malicious communications? sexual assault was put online. There was death threats and threats of violence as well.

    Defamation would be defamation act?

    Data protection breaches would be data protection act and GDPR

    Any laws for malicious police reports?

    Have I got it all correct? most of it would be tort law?

    It will be litigant in person and a high court claim.

    An anonymity order will be needed.

    The defendant has not replied to any letters or letters before action so will be asking for sanctions.

    What damages can be asked for? aggravated damages due to the conduct of the defendant? Defendant was in a position of trust for vulnerable people. Still works with vulnerable people. Can it be asked for an order that the Defendant stops working with vulnerable people? Any declaratory relief?

    Need to write the particulars of claim soon.

      It has been reported to the police. Case was closed by victim due to intimidation and stress, but can be reopened at any time. Some of the incidents the statue of limitations have run out in criminal law but there is still time in civil law.

      The police have said to continue down the civil route as there is evidence of the stuff that time limit has run out for police to prosecute.
      All of the stuff would win on civil evidence on a balance of probabilities but may not on criminal evidence as beyond reasonable doubt. (The Ella Janneh court case is an example of the evidence rules between civil and criminal)
      Police have said to keep them informed of the civil outcome.

      The victim will like to remain anonymous.

      The victim understands that if this goes to civil trial without a settlement then it will be case law and will help others so wants to proceed.

      The victim gets help with fees and can't afford a lawyer.
