  • N244 Mistake - Urgent

    Hi,

    I am in a bit of a mess here with submitting my documents. I filed an n244 on Friday at 4pm to extend the time for my submission of a trial bundle, but forgot to complete question 3; which is where you write down what you are doing the n244 for! I was lacking sleep and in a bit of a rush (realising i couldn't make the deadline for my trial bundle) and made the error when copying similar data over from a previous n244 that i had done for the same reason. I did complete question 10, the witness statement, where it asks me for more information about my request; but, that on it's own is very vague (as to what i am asking for) and gives no timeline for my request.
    What should i do, given that I filed it on the last weekday date before the deadline (Saturday/today)?
    The only things i can think of are:
    1. Do a new n244 and hope that no one makes a big fuss that i was late.
    2. Go to the court on Monday very early in the morning before they have processed the n244 and ask them if i can adjust it
    3. Get the paperwork (trial bundle) in now for a weekend deadline day (a Saturday) and hope for the best.
    4. Do another n244 today online as the deadline is today (Saturday).
    5. Hope the judge will be lenient on me as a litigant in person and just get the paperwork in when i can.
    Does anyone know a good way out of this?

    I would do No 3, get the Trial Bundle, '3. Get the paperwork (trial bundle) in now for a weekend deadline day (a Saturday) and hope for the best.'

    Apologise for the error, add a sheet correcting the omission from the N244 form, ask them to attach it to your N244 form.

    or I suppose you could do the N244 again with the Trial Bundle at you are still within the deadline which is today. Add a letter asking them to remove / cancel the original N244 with the error.

    No doubt there will be other suggestions.

        I am surprised the court set a deadline on a Saturday
        I may be wrong but I thought I read in cpr that if documents are received (including electronic transmission or hand delivery) at the weekend, they are counted as being filed on the next working day

          Yes, the court set a deadline of a Saturday and why i was aiming for yesterday. I had thought what you said was correct about doing it the day before.

          To add to my problems my printer has packed up today of all days (after 7 years), so i don't think i can get this done into the night now and get it printed anywhere. I've got a new printer being delivered on Tuesday. I think all my luck has just run out!

            You can get it printed if you have a library that's open that's close to you.

              Thank you, but that's not enough time i don't think. The reason i mucked this up is because i tried to rush to make a deadline that was never going to happen. If i had till midnight tonight that might have been possible (if the printer was working!). The only people i know in the area is my sister but they don't have a printer.

              I might be able to get away with printing a couple of sheets for another N244. The main tray is not picking up the paper, but I am able to feed paper through the front sometimes, but it keeps grabbing about 30 bits of paper at once. Sorry, i shouldn't have mentioned my printing issues as well

                Check 'Youtube' might be a solution on there (caveat I don't know you, I don't know your printer).

                  The printer pick up is something that went last week. A printer expert said i need to get it into him really, but advised me how to use the front of the printer. That was working till the early hours of this morning. I might be able to get the odd paper through. If i can get it to print the whole thing is that even the best option? I wasn't sure from what the other guy said? I also know someone an hour away that might print for me at say 9pm, but i doubt he wants to be doing that on a Saturday night. I moved to a new area at the beginning of the summer (hence why i am struggling with deadlines).

                  Is there no way of intercepting the document at the court on Monday if i go in and apologise and ask them if they can let me make the adjustment? Or otherwise, just do another n244? I also received a letter this week from my previous n244 (for the same case), dated 1st November (telling me i have till the 25th October to do the trial bundle). The date the letter was produced is 6 days after the deadline they have accepted as set. I had previously asked for 6 more weeks. Then asked for another 2 more weeks (till yesterday).

                    If you have your local Courts email address then you can email the N244 and Witness Statement to them.

                    Tell them in an email that this supersedes the postal N244.

                    You can do the same for the Claimant if they accept your documentation via email.

I am just worried that by sending another one saying it "supercedes" the one from yesterday they will then throw away one that might have a better chance of being accepted.                       Doesn't the defendant get emailed my n244 by the courts? Why do i need to send to him anything? He is not going to help me in any way.

                        Yes, but you need to send him the Witness Statement,because it's in the CPR 'Doesn't the defendant get emailed my n244 by the courts? Why do i need to send to him anything?'

                          I didn't send him the n244 when i did it yesterday. Are you saying because this is an ammendment to an n244 i need to do that?
