  • Reserved Legal Activity?

    Quick Question:
1 Is drafting a Defence and/or a Witness Statement for a Litigant in Person a reserved legal activity?
2 Is drafting a proposed Tomlin Order for a Litigant in Person pursuant to settlement negotiations a reserved legal activity?

Neither of those is a reserved activity. See:

    https://legalservicesboard.org.uk/en...gal-activities

    https://www.legislation.gov.uk/ukpga/2007/29/schedule/2 - para 4.

If they were reserved activities, some members of this forum would be in trouble!
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf

That's what I thought & I am glad of the confirmation!

The reason for my query was that I was in a solicitor's office yesterday helping a LIP "pro bono" facing repossession proceedings and the docs above that I had drafted for that LIP were being examined by a trainee solicitor a couple of month's shy of qualifying who told me that my drafting of those (signed by the LIP) was a reserved activity.

The good news was that the LIP obtained non means tested Legal Aid (Up to trial - after that Legal Aid is means tested.)

It would seem that non means tested Legal Aid for possession proceedings was restored about a year ago, having been removed some years ago. (This according to the trainee solicitor - I do hope she is right about that!)
