Broad and short. Well as short as I can make it.... Brief background. I helped out an elderly lady who was a friend of the family. She came across as the frail old nice lady at first... She was having money difficulties and lived in sum what squaller. Lent her £5k, lent her a car, moved her to an apartment in a nice area of Cheshire from a run down area in Leeds, sorted out her finances and completely renovated the apartment for her. I've sorted out her health care and taken her to and from hospital appointments for over a year. I've pretty much sorted out her complete life. Unfortunately my time has had to be focused on my family in recent months and she has spat her dummy out because I am not at her becon call. Progressively over the past year I have heard reports from the neighbours of her being blind drunk staggering around the apartments arguing with people. She is driving my car drunk... She has fallen out with all the neighbours.... she has become very rude and demanding of me, she is rude and racist (very embarrassing to be around her in public) she still hasn't paid me back the £5k despite having it in her bank account, I'm expected to pay every time I have to help her.... the list goes on. Without raising my voice I ended up having words and at the end of my conversation (mainly her swearing at me) I asked for my money back and the car. She told me to F off and used the C word....
Here's my question. The cost effectiveness and time required of getting the £5k through court seems uneconomical but I do however want my car back. It has a private plate that is worth as much as the car. I own the car out right, the registration details are in my name. The car is accessible at all times from the car park near her apartment and I have the spare key. I have asked the police they said I can go and collect it as long as I give her a letter of warning. I've read about sending her a letter of "delivery up" I'm trying to keep this cost effective and out of court. Car and plate combination is about £7k. What are your thoughts. Can I just collect it?
