  • Pre-Action Protocol - asserting there has been a breach?

    Within the draft Directions I recently submitted for my Housing Disrepair claim, using the multi-track standard Directions Orders as a template, the following was stated regarding any breaches of the Pre-Action Protocol:

    "any party asserting a breach of the Pre-Action Protocol for Housing Disrepair cases (Wales) must serve a statement setting out the alleged breach and its effect"

    Can anyone please advise as to the format that I should use to submit this statement? i.e. would a Witness Statement be appropriate?
