    Hi

    I had a county court claim struck out - I made an application to reinstate it, but this was dismissed - I have then appealed to the 'Appeal Centre' and permission to appeal has been refused on the papers as 'totally without merit', so I have no right to an oral hearing.

    It is not totally without merit, but I did not present my appeal well on the grounds of appeal. Can I appeal the refusal of permission to appeal and, if so, would this be to the High Court or the Court of Appeal?...or do I not have a right of appeal and, if so, would my only option be Judicial Review?

    or possibly an application to re-open the appeal under cpr 52.30?

      CPR 52.30 is exceptional cases only and necessary to avoid a real injustice, and messing up your appeal does not fall under either of those categories.

      What makes you think you cannot request an oral hearing? CPR 52.4(2) allows for that, and Practice Direction 52B would apply, specifically paragraphs 7.2 and 7.4 unless CPR 52.4(3) applies then it really is end of the road.
