    Thankyou in advance.

    We are in the process of going through a money claim.

    The defendants solicitor asked us for an extention to file their defence, we agreed to the extention and they have sent me a draft consent order to sign.

    Im dubious of the wording on point 3 "cost in the case"

    ​​​​​​I don't want to be agreeing that I will be in debt to them for filing this order.

    This means that the costs will be paid by the eventual loser to the eventual winner.

    You could try amending this to say "no order as to costs", on the basis that you have incurred no cost in dealing with this. That will mean that the defendant will have to pay his lawyers with no possibility of one day getting those costs back from you.
