  • MCOL Judgement won, bailiffs unsuccessful. Next step?

I raised a claim through Money Claim Online (UK) against a company that did our Patio for £3000, which was poorly put in. We won the judgement by default as they didn't respond. I tried the county court bailiffs, but they failed, so I went with another company for the bailiffs, and they failed too, as apparently, they've moved address even though the address is still the same on Company House. Even though the patio company has contacted me and they're well aware they have a CCJ against them, I'm suspicious that they're still at that address. I've had a look and I believe this is the next step to freeze their accounts and get money that way; https://www.gov.uk/government/public...rty-debt-order But I'm not sure how to correctly fill it in or send it off. I'm wondering if anyone else has had a similar experience and what my next steps should be.

    Thanks

I had an unpaid ccj against a person (not a company). I put a charge on their house but also escalated it to the High Court. Their High Court Baliffs did an excellent job and got me a monthly payment (not much but made me feel good!) FInally the house needed to be sold so the debt was paid off in full. If you can escalate it to the high court that would be a good way forward. I have no experience re debt orders but hopefully someone else will come along and help.

The bailiff company I went with were high court enforcers, and they came back with; "Debtor no longer resides at the address agent met with current occupant who provided relevant proof of residency/ID to agent on visit." And they were unable to trace the new address. And they haven't updated the address on Company House.

OK I see - I did not realize that as you did not say you had paid the extra fees and transferred matters up to the High Court just that you used another company. Could you trace them to their new address if they are still trading - get someone to request a quote from them for example? Otherwise looks like you will need to go down other routes on which other members may be able to give you more information.

The high court agents tried to find their new address but failed, and I believe they're using the old address on their invoices still. So I'm looking at what else I could do, such as the third party debt order

SlippinJimmy did you have any further luck? Its worth going to a specialist trace agent and not just the standard desktop one that the bailiffs offer.
