  • Theft ?

    The garage had 2 of my cars they gave me one back lots still wrong with it . So paid about 75% but they have kept the other car by mechanics lien even though two different bills so it’s not one big lien covering both cars . As I have fully paid for the car that they have it’s mine so they have committed theft ! Do I take them to a criminal court or do I get the police involved ?

    Not theft
    Theft is dishonest apprpriation of property belonging to another.
    They say you owe them money. They are keeping the property you handed to them until you pay. They are exercising a lien. The lien cobvers anything they have in their possession. Which car it is over makes no difference. No clear dishonesty.

      So your sensible way of progressing is to pay, recover your property and then perhaps initiate a court claim.

      Consumer Rights Act 2015 requires service contracts to be carried out with reasonable care and skill.
      Depending on how well they did (not) perform you may have grounds for a claim against the garage.

          but the car that I have I have spent about £2000 to get it road worthy the workmanship was actually very bad and dangerous

            But the car that I have was given back to me in a dangerous condition still leaked oil have not done a lot they have charged me for and I am still expected to pay them

              As Des advised you pay the balance, go to another garage get a written report as evidence then off to the small claims court.
