  • Simultaneous court claim and complaint to FOS

    I have a current claim against a travel company and a bank. Several months before bringing the claim, I had complained to the FOS about the bank - my complaint was unacknowledged and I simply forgot about it. At the time I filed the online claim, the FOS got in touch with me to say they will now investigate my bank complaint. I think this is probably unethical to have the simultaneous court claim and the FOS complaint but is it unlawful and what should I do about it.

    You have a choice of either withdrawing the FOS complaint, or applying to stay the court claim whilst the FOS complaint proceeds.
