    Evening All,

    We’ve had a nightmare with a recent purchase of a static caravan, and whilst the company is looking to give a full refund, they have made it clear that any associated costs we incurred nor any compensation will be considered.

    I think the only way we’re going to be able to attempt to get these costs back is by bribing a court claim.

    if I want to specific a value for compensation for emotional distress, lack of enjoyment and threat to health (black mould) how do I attempt to come up with a value?

    You have very little grounds for claiming any worthwhile amount in compensation for emotional stress & loss of enjoyment. A threat to health is rather nebulous.
    Although this concerned a building dispute the recent case of Vyas and another v Goraya (trading as Taj Construction Roofing) [2016] EWCA Civ 1095 restated the current law that any awards will be modest and not exceed £3000 per annum in the absence of any physical evidence of the illnesses allegedly caused.

    You might recoup your losses directly caused by breach of contract, but if it means court that will not be stress free.

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
