I made standard disclosure to the other party at the beginning of this week in accordance with Directions Order. There are a number of documents (already in my control) that I did not consider to be relevant to the case; however, having received the other party's disclosure list, which contains documents that I considered irrelevant, I now feel that I should in fact have disclosed these.
What should I do? Can I just disclose them now (say before the end of the week) or will there be an issue with this? The case is not due to be heard until the end of this year and witness statements are not due for around a month.
Also, I note that CPR states there is a continuing obligation to disclose documents that come to a party's notice. I am in the process of obtaining further documents, that have never been in my control, so am I correct in thinking that I will have no issue disclosing these, once received, in accordance with CPR 31.11?
