    Firstly I'd like to apologise in advance . I'm sure I will have made some mistake from the correct forum place to misunderstanding the legal terminology I'm about to ask your advice on.

    I have started court proceedings to take a second hand car dealer to court for mis-selling me a car. They advised the car came with a full service history and after nearly 6 months of constant communications on my behalf they finally admitted the car actually had a 7 year gap in the cars service history. I immediately advised they missold and therefore there was a breach of contract. The refused to take the car back and I was left with no option but to make it a legal matter.

    I have received form N181 but I've managed to stumble through but the part I'm really struggling with is section 'J' which asks for "Draft of the order for directions". I have tried to read the legal content online 'CPR PART 28' but I'm still have no idea what its actually asking or how I'm meant to word what they're asking for.

    Any help would be greatly appreciated.

    The draft directions are what the court will make in terms of disclosure, exchange of witness statements and expert evidence. The parties should try to agree the draft directions wherever possible to assist the court so if the car dealer has instructed a solicitor you may want to contact them in that respect.

    The Appendix of Part 28 sets out the standard directions, but it would be up to you to decide which ones to retain or exclude. Obviously without having knowledge of your claim, it's difficult to tell you what to include in the draft directions. If you are struggling, include everything on the standard directions example except for the expert evidence sections unless you or the other side intend to rely on an expert in which case that needs to be completed, hence it would be sensible to agree mutually where you can.

      Communication with the car dealer are non existent at this point.is there any chance you can point me in the right direction to this list of draft directions? All I've managed to find so far are ones for a PCN.

        make a list of all the documents*you are going*to use in your case and attach copies :-*a witness statement (just write what happened) and copies of any paperwork you have, the receipt, service history logbook, copies of any letters or emails between you, bill of sale, company's policy, terms and conditions, guarantee*etc etc ... basically a witness statement and every scrap of paper you have !!
