  • CPR 39.8 and it's compliance

    Hi,*

I had default judgement awarded, which my claimant is trying to set aside.

I sent an email to the court and the claimant outlining reasons for set aside as not valid.

Today i have received a letter saying that my communication is returned pursuant subject to cpr39.8 (5).

To ensure my letter is reviewed do i simply add a line to say:
âAtt to District Judge re court case

    Dear sir or madam,

*i am cc'ing the claimant on the following email*

And then continuing with the rest of the emai?
    âthanks

You need to state it is being sent to Mr xx, the claimant.
and actually copy them in on the email
