  • Advice on bringing TUI to small claims court

    After the holiday from hell with TUI we went through ABTA and TUI offered £102 the £2 it's for postage of the letter
    we declined this and went to the CEDAR who then advised that what we were offered was enough
    so now we have gone back to TUI and advised them we will take the first offer after all. But they have sent an email stating they sent the cheque which we sent back. Two emails later and few weeks later , we got a generic email saying they will get back to us in 28 days despite my email stating that we expect to hear from them in 7 days
    I am thinking of taking them to small claims court asking for the £102 and ask the judge to award us the court charges
    l am going to write a letter advising them of my intention and give them another 7 days to respond
    do u think it is a good idea or will l lose this ...? Thank you in advance

    As you have now accepted the offer, I would await their response, even if it takes 28 days.

    Firstly consider the up front costs of court action and stress against the potential reward.
    At least wait until the 28 days are up.

    TUI of course might well claim that your rejection of their offer terminated the offer, and that it is no longer available.
    If you were to take them to court, win but only be awarded the same or a lesser sum you might end up paying their costs.
    It will depend on the wording of that rejected offer. and how TUI play it, viewing the small amount.

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
