Court Claim - Motormile / Northway Broker (I don't know who they are) - 14-8-2017

    Ok so had a good look through my paperwork and I cannot locate anything from swift sterling. I have found paperwork for lending stream which seems to fit roughly with the amounts and fits with dates. The confusion here is that lending stream issue 2 loans and one is now assigned to motormile and the other to PRA group. It's the motormile one that I think they have issued the claim for.

    now, in August 2016 I sent an affordability complaint to lending stream and this went on and on - they refused to accept liability and I highlighted to them that in July 2011 (in between the 2 loans) that I advised them of my health issues and sent evidence (I no longer have proof of postage of this) but rather than manage this they issued me with a further loan - however they requested this evidence again during the complaint and I sent it to them. Unfortunately I didn't chase this up further and heard nothing further so doubt I will be able to go to FOS now although they haven't issued a final decision.

    i still did not receive default notices nor notice of assignment for the motormile and confused as to the actual default as if they are treating it as 2 loans this relates to the later loan not the original and I have no default dates or notice for that - I'm not even sure that appears on my credit file? It's difficult when debts are assigned as they tend to lump it all together and it's not easy to see what you owe to whom.

    Anyway given this I am going to acknowledge the claim with the court and still try and defend. I am going to request the necessary documentation from MMF and I will also request all my personal information (freedom of information) just to piss them off and to get them to send me everything relating to my 'account'. This is a laborious task and they may think it's not worth the hassle, but it may give me information to support my defence.

    I especially want to highlight that they refused to support when furnished with my mental health issues and instead chose to issue a further loan. I don't know if that will work or whether that's any sort of defence but given my complaint and the lack of communication from both lending stream and motormile I had every reason to believe they were no longer pursuing the debt. I am still confused that the claim states the debt is from Northway? I still have no clue about that and I may have got it wrong about the lending stream association but it's seems to fit.

    Hopefully when they send me the relevant info requested I will be enlightened.

    does this seem ok? Any advice much appreciated.

    i have had an overwhelming evening facing all of my past debts and as a few are approaching the 6 year mark I am expecting more claims to start landing on my doormat. I think I need to try and sort them out before that happens because this is incredibly distressing when I've worked so hard to get better and rebuild my credit I was looking forward to being free of it all by next year.

I don't know if this is the same debt. I wasn't pursued for that debt and as far as I can recall I'm not aware of motormile.

      i received a letter from moriarity law yesterday stating they had submitted a claim to the county court and I could still stip this and today received the claim from the court.

      i don't know what to do I want to avoid a CCJ at all costs as I have worked hard over the past 6 years to rebuild my life after debt and illness and this will just set it all back. I don't have the money to repay in full.
      OK you have received a court Claim. You need to acknowledge the claim on line which will give you thirty three days. Start a new thread about the claim and the kind people here will help you through.

        Do you still have bank statements from that time , they should show where the money came from

        Did you have any pdls from swift or pounds til payday

        It all seems somewhat strange to me but of course when there are so many it is difficult to remember exactly who you borrowed off. I only know because I was in a dump and there is a list showing who was being paid.

          Thankyou -- I have now acknowledged the claim and my intention to defend. I have today sent emails and letters to both MMF, lending stream and Moriarty Law requesting CCA, notice of assignment and notice of defaults. Special delivery with proof of postage - So now I wait to see what turns up I guess.

          I haven't slept all night worrying and decided to tackle some of the other debts/defaults that I am not being chased for as they are due to drop off in the next few months.

          PRA have sent me statements for some other payday loans and within that made offers for full and final settlement of 20% of the outstanding debt, so am going to request CCA for those and if they are forthcoming settle on that reduced figure if I can scrape enough cash together and then that will be the end of that. I also have an ongoing disputes with an old current account default which I believe to be worthy of complaint so going to try that too - I have requested subject access and detailed my complaint about the debt as it was charges brought another by a packaged account which I feel was misold and they failed to cancel.
          I also notice a payday loan was closed and redressed and that is still appearing on my file when I have written notice that they are removing it - so need to sort that too.

          Anyway im just ranting - high on caffeine and no sleep...

          thankyou for all your advice if there's anything else I need to do please let me know but I will update further if and when I get a response from MMF re the CCA which I suspect I will and see where I can go from there...

            I am sure I did have a loan with swift but nothing on my credit file and have no paperwork?!

            No I don't have anything like bank stats I don't have those bank accounts anymore. That said I have requested CCA etc.. so perhaps that will shed some light on the matter. It was such a long time ago I was incredibly ill mentally and don't remember taking them out if I'm honest - life was a blur I was manic (bipolar) and didn't know what I was doing.

            This whole nightmare cost me my marriage, my job and my sanity and almost my life - I'm glad I'm doing better now but this has set me back as I was working towards being free of it all in a few months and getting some control back. I've tended to ignore it if they've not pursued me and now worry that as I'm approaching an SB situation with some of them they will all start proceedings. I cannot afford to repay in full so it's probably time to deal with it head on. The defaults will all be fine this time next year so the end is nigh... we will see it's tempting not to disturb a sleeping lion but I think living on the edge is not good for me either :-(
