  • Two CCJ's issued on statute barred debts - Please help !!

    Hi Guys,

    around 12 years ago i ran up a load of debt when i was young and stupid, it took me years to get myself sorted and to finally have a good credit file. I receive my credit scores / reports monthly and have noticed that i have had two CCJ's issued to me in April of this year. I know that any debts i had have not been paid for over 7 years and have not acknowledged any debts in this time either.

    I had quite a few debts at the time and therefore i am not sure which debts i have been given the CCJ's against but my plan was, knowing that they are definately statute barred if they did rear their ugly heads i would send them a statute barred letter.

    I never received any court forms for me to file my defence although these could have gone to an earlier address, i did have mail redirection set up but it ran out in February of this year.

    My question is , is there anything i can do to have these removed with them being statute barred and if so what do i need to do , i have had a quick read online and i think i may be able to get them set aside ? but i think i have to pay a fee per CCJ, is ths right even though i never received the court forms and they were unenforceable ?

    Pinpointing the 'commencement' date for the statute barring limitation period can be notoriously difficult, & often will depend on the type of agreement, whether it was regulated via the Consumer Credit Act (eg credit cards loans) etc.

      Thanks for the reply, it will probably be a credit card or could possible be a bank overdraft
