  • N power County court claim

    long story short we have been trying to get away from npower for years. misold dual fuel and they wrote off gas bill but refused for the electric . they let us go with the gas but not electric . sent us 1 years worth of bills in 1 envelope . we have followed all complaints procedures , got told we could leave then told we couldnt. bills got higher we paid each month on a plan tht they kept increasing. Finally they let us go after 2 years at least of battles. Now they have taken me to court regarding outstanding balance that we have disputed but got nowhere . gone in a full circle. Need to put a defence in for court claim
    I have emailed ceo paul coffey and his pa has passed my issues onto the executive complaints team but im stuck with the defence? could anyone help me please ??

    i have emailed wilkin chapman llp to tell them the debt is in dispute and back with the claimant n.power and to stop any further collection action ?

    Firstly complete acknowledgement of service form and send to court to get more time.

    Then post up Particulars of Claim so someone here can advise you on a defence.

        hi guys. so i did my defence after giving it some thought we shall see how it goes .... meanwhile Npower complaints have got back to me with some garbage about us not been eligible for back billing with a load of bumf attached to the letter that smacks of a fob of and told me to go to obudsman. ive emailed them back telling them i want a FULL investigation not a garbled load of codswolup dressed up with fancy words to get out of the actual complaints. thankyou in advance for any help in dealing with NP and for those that have replied so far

            hi guys sorry i havent responded yet .... life gets in the way .! i will forward the letter to you no problem. they sent it the exact same day i emailed them so no way did they do any research blabla.
            latest is the ombudsman got a big fat fob off as well so i have told them more about it as i dont think i did the first time, never done it before so its all new to me and they have gone back for more investigation . in the meantime i defended the county court claim but np have now continued with the claim and i have a directions questionaire from the small claims court....? it suggests that mediation is the way to stop the claim and try and get a resolve but im waiting for ombudsman so im confused as to what to do really.? NP are so wrong in what they have told ombudsman, basically told them lies. they say the bill is accurate and that its based on meter readings yet the letter they sent me saying they would FINALLY let me leave states its based on estimates? I also have a final bill for gas and electric together back when they let us go for gas but not the electric. they say they sent a deadlock letter but at the time we contined to follow up on complaints that were not resolved and they continued to respond so its all a load of ballony that they have told ombudsman. Can i get an SAR to get all live chats and other information they hold on me? I want to wipe floor with them but im really up against it as they keep trotting out the same lines. They say they offered £50 compo when they refused to let us leave with the electric but we said no chance we want to leave and refused to accept it. Yet they have told ombudsman they gave it to us and that was matter closed but we had complaints open all over the place with them ! SO FRUSTRATING. i have emailed exec complaints got nothing back. The ombudmans infer that we are avoiding payment by trying to use the backbilling rule which i can only summise is from what NP have told them .

            am writing to confirm the outcome of my investigation into the complaint you made about npower.

             

            I have considered the information provided by both parties. This includes your complaint summary. npower has provided a file that includes account notes, copy correspondence, copy bills and a complaint summary. 


            Your complaint relates to the large outstanding balance on your electricity account with npower.                      

            You state you were mis-sold your dual fuel by npower in 2012. You state npower wrote off the balance of your gas account due to the mis-selling issue but did not write off the electricity balance. You state you have transferred your gas supply to another supply but npower would not allow you to transfer the electricity supply due to the large outstanding balance. You state you have now transferred your electricity supply but npower is following debt collection processes for the balance, which you do not consider you owe. You consider you have experienced poor customer service and would like npower to write off the electricity balance.

            npower has confirmed you transferred your gas supply away from npower on 3 June 2014 but as a final and accurate bill for gas was not produced until 22 June 2015, the gas balance was removed under the application of Energy UK’s Code of Practice for Accurate Bills (The Code). npower has also confirmed that the electricity had been billed correctly based on actual meter readings, meaning The Code did not apply to the electricity account.

            Energy UK’s Code for Accurate Bills (the Code) outlines the key commitments by the participating energy suppliers to provide accurate bills as well as your obligations as an energy customer. The main reason for publishing the Code is to assure customers of the suppliers’ commitment to high standards that provide clear, accurate, informative and timely bills and statements.

            The Code for Accurate Bills states that if your supplier is at fault, they will not seek additional payment for unbilled energy accrued more than one year prior to the bill being issued.

            The back billing clause is not intended as a means for avoiding payment .You as a customer should pay for energy used and have an obligation to assist your supplier by co-operating with attempts to obtain meter readings or resolve queries from your supplier.

            I have noted your comments that you consider the electricity balance should have been withdrawn when the gas balance was withdrawn. However, given the evidence provided by npower, I am satisfied the electricity account was billed accurately and The Code was not applicable. I am therefore unable to agree npower should withdraw the balance of the electricity account.

            I have also noted your comments that you consider the dual fuel contract was mis-sold to you in 2012. I have not been provided with any evidence to substantiate this claim and I am unable to comment on the matter further.

            As the evidence confirms that the charges applied to your account are correct and reflective of your consumption, it is only reasonable that you remain responsible for the energy you have consumed. However, we acknowledge that payment may not be affordable in full and as you should contact npower directly to discuss a payment plan, based on your ability to pay. Please note that the precise terms of any payment plan are at the company’s discretion.

            npower has confirmed that in light of its failure to provide a clear explanation at an earlier opportunity, it applied a credit of £50 as a gesture of goodwill. I consider this reasonable given the circumstances and do not require any further action from npower.

            Following my investigation of your complaint, my decision requires no remedy or award.
            You now have to decide whether you accept our resolution in full and final settlement of your complaint. Please provide a response within 14 days of the date of this correspondence.

            i have since told them more about that saga ...... ( 2013 to 2016 is a lot of history to get into a small box )!

                im back.

                thought npower had gone away but WC have now got a ccj againt my partner (accounts in his name ) as they pursued debt collection even though was under investigation with ombudsman. i filed an n180 DQ with the court which i have proof of but they say i did not do it properly so wouldnt accept it even though its clear i sent it . i wanted mediation. i want WC to cancel the ccj but they will not respond, im worried cannot afford a set aside at £255 and if we lose that we end up owing more when all this could have been sorted had WC acted properly. NPower told me i can pay them yet WC WANT BLOOD. help ive tried everything im lost

                  can anyone help? have to set aside but its £250? applied for fee waiver but heard nothing so now i dont know what to do ? tried ringing court. no joy there.

                      hi there yes this is what happened. i emailed it all to the court but apparently it was the incorrect address so never arrived in the inbox. I have since been in touch with the court and the district judge has written saying to apply to have it set aside and send a copy of the questionnaire which I am in the process of doing this however cannot afford the fee so i have applied for a waiver but have not heard back as to if this has been granted and cannot seem to find out ?? thanks

                          just an updatge i have practically begged paul coffey ceo of npower for help but got nowhere. they dont want to know even though they caused this mess... so im still trying to sort this out via the courts. short of going to the press i do not know what to do.

                            ok so i have raised as SAR with NPOWER to get ALL the info they have on me and my accounts....im thinking of taking them to court but i do not know where to start and do not want it to cost me a fortune, i just want them to leave me alone

                              UPDATE. Received the SAR paperwork. Light bedtime reading ! Unvailed a mass of bills which we did not receive and it took them a full year to close down the gas.account and split the bill so the bills for a year were.in accurate and a mess. They send bills in bulk in march 2015 and june 2015. There notes state the whole sorry mess surrounding us actually been allowed to leave with electric. I have asked exec complaints again for mediation in light of what i have found so far. Its suh a mess. What now?
