  • County Court Claim from Lovells

    Hi
    i need some help filling in online defence (MCOL). I have been erved the County Court Claim by B&W Legal. The amount is for £193.41 plus fees etc.
    The money is for British telecom. Now, i dont actually owe any money to BT. In July 2012 British Telecom wrongly charged me £193.41. This was taken from my bank account. I phoned BT and i was refunded the next day! This is clearly shown on my Bank Statements. Several years later i received a letter from Lovells saying i owed BT money. I phoned BT who then apologized and said i should ignore the letter. I heard nothing for another year or so and then the letters started again! I just ignored them. Now they have sent the Court Claim. i phoned up BT and asked them what was going on and they couldnt give me an answer and said i don't owe them any money at all!
    I am not sure what to write in my defence so please can anyone give me advice. I have looked at the templates and i'm not sure they apply here as they are for loans/debts that haven't been paid whereas in my case i don't owe any money and have been harrassed for nearly 5 years now.
    Do i need to post my defence or is the online method all i need to do?

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
