I had a credit card with sygma bank which I last paid for in June 2009. I received a claim form and I filled in the defence section saying this now a statute barred debt. However, Lowell solicitors who the debt was passed onto have responded to the claim form saying I cannot use limitation act because debt is based upon a simple contract, the relevant limitation period is 6 years from when the cause of action arises pursuant to section 5 of the limitation act. the agreement was not terminated until it defaulted in March 2011 due to non-payment. The cause of action for the full amount claimed arose from then. Is this correct? March 2011 is the date the debt is passed onto Lowell solicitors however I would have already been in default since missing payments from August 2009.
