Just looking for a bit of help, received a claim through the post yesterday from Lowell in reference to a debt with Vanquis. Think it was for a credit card I had back in December 2011, had just left Uni at the time and was in and out of work so struggled with payments. It says the default date was 28/06/2013 - I think the payments stopped like 2011/12ish as I remember losing my job after having the card, so this default date seems quite a bit away.
Anyway, I have been working on clearing debts and had forgot about this one, I really do not want the CCJ showing up on my file as we are planning to go for a mortgage once the default drops off, and this will ruin my file again for another 6 years.
I am not really in a position to pay the balance off in full at the moment, they want £506.00 in total.
What are my options? I will acknowledge the claim today.
Is it worth me contesting it risking getting the CCJ, or could I take another approach and get a Consent/Tomlin order I had seen and agree a payment plan?
My end goal is to just not have a CCJ from this, your help would be appreciated.
Particulars of the claim are:
1) The defendant entered in a Consumer Credit Act 1974 regulated agreement with Vanquis under account reference XXXXXXXXXXXXXXXX ('the agreement').
2) The defendant failed to maintain the required payments and a default notice was served and not complied with.
3) The agreement was later assigned to the claimant on 18/12/2013 and notice given to the defendant.
4) Despite repeated requests for payment, the sum of £390.15 remains due and outstanding.
AND the Claimant claims
a) The said sum of £390.15
b) Interest pursuant to s69 County Courts Act 1984 at the rate of 8% per annum from the date of assignment to the date of issue, accruing at a daily rate of £0.086, but limited to one year, being £31.21
c) Costs
