  • Robinson Way/ Howard Cohen Query

    Hi again

I've been hit with a CCJ claim and have got as far as sending off my CCA and CPR and filing my defence.

I received and acknowledgment of my defence yesterday and today received a letter from Robinson Way ( who I did not send the CCA request to - that was Hoist Portfolio Holdings) with my Postal Order returned and the letter stating:

"We acknowledge receipt of your request under sections 77-79 of the Consumer Credit Act.

Your account is now with out client's solicitor Howerd Cohen & Co and they have issued a County Court Claim against you.

We have forwarded your request to our client, as under CPR 31.14 you are etitled to request this documentation.

However, as a County Court Judgement has now been rquested it may still be enetered against you in this matter. Therefore please find enclosed your £1.00 fee.

    Blah blah blah
To me this is complete nonsense? They are telling me what I've already told them; it seems the Debt collection agency I supposedly owe money to has passed it on to another DCA who have passed it on to the solictor. And to top it all they have sent back my postal order which is of no use to me as I made it payable to them??

I'm not sure what's going on with this. Additionally if they were to supply me with the requested documentation I would need a lot more help as this account became a real mess and I would need to counter claim as I made payments to another DCA that I believe were not accounted for.

But in the first instance I'm asking for some advice on what this letter means! Many thanks
