    Hello,

    I have received the following claim

    Issue Date: 23 Aug

    Amount approx: £250 + £25 court fees + £50 legal fees

    Claimant:
    Cabot Financial

    Solicitor:
    Restons Solicitors

    Original Creditor:
    HSBC

    Particulars of Claim: Please type out in full excluding names/account numbers

    This relates to an old current account with HSBC from the early 2000's that I stopped using and forgot about and so never closed.

    2 years after moving house I was contacted by a debt collector stating this account had an unauthorised overdraft of around £800 - it turned out this was almost entirely bank charges that has been added as HSBC couldn't get in contact.

    I made an agreement that they would write off 25% and pay the rest in instalments @ £20 a month and as long as the payments were made no default would be issued.

    Everything seemed fine until Cabot purchased the debt, since then its been a nightmare. For example as soon as the debt was purchased they placed a default on my credit file, they initially kept sending letters to my old address. After 6 months of this I eventually managed to agree payments of £12 a month by standing order

    Today out of the blue I have received this court order. Have just looked back through my bank statements and found that 3 months ago I missed 1 payment, I guess this is the reason.

    I don't contest the debt but not happy with not receiving any communication from them advising there was any issues as well as £75 of charges being added.

    As the remaining balance now is pretty small I don't want that to end up with a CCJ - if could get some advice please?

    If I return N9A accepting the full amount including the new fees and offering monthly payments are they still likely to proceed with the claim?

    Just a thought , was there any PPI on the account
    Was it a current where you paid a monthly fee.
    I know this isn't relevant to your claim, but they may owe you money.

      all dca want is £
      as small it probably best to make offer
      but don't accept fees
      do a notice to them explaining all the above- and mess up THEY made but you willing to be amicable and will offer the max your current financial circumstances allow that of £xx per month to pay a total alleged debt of £250 ONLY, as any fees are their fault for not administrating your account correctly.
      enclose a cheque for £xx and state if banked this agrees all parties agree to the terms set out in this notice etc etc

      hope that helps

      or just pay the full £250 and move on
