  • Defaulted on overdraft now being taken to court by 1St credit

    Hello everyone
    Just joined so sorry if I'm breaking any etiquette by posting.
    So I'm being taken to court for defaulting on an overdraft in 2012 the debt has been sold to debt collectors called 1St credit. I ignored letters for year now I'm trying to deal with it. If I wasn't struggling so much for money I'd pay at least half of it but since there money making pros I don't feel any moral objection to trting to get out of it.

    I've responded online asking for more time and have so far been bewildering myself with all the online info

    I want to know what my beat possible defence could be. I'm aware it will cost me more to defend the claim if I lose and that's quite worrying

    Question time
    1- Does the debt collector have to prove the debt

    If they can't do I not have to pay?

    2- how can I ensure I don't pay the debt without risking paying more

    3- how would I word my defence to try wriggle out of it without incriminating myself

    1, You have received a County Court Claim Form ? When? Have you acknowledged service of the claim? Have you entered anything in defence online?

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
