    Hi

    Please hep me. I came home yesterday to a court claim. Claimant Arrow Global and the Solicitors Restons. I had two previous correspondance from this solicitors which I ignored as I had no idea who they were and thought that this may be some sort of scam as I do not remember owing them money. Particulars state:
    " The claimant claims payment of the overdue balance due from the defendent under a contract between the defendant and Santander. dated on or about Aug 24 2007 and assigned to the claiment on May 10 2013.

    I really do not know what this is about. I was living elsewhere at the time also. Please advise as I apparently owe nearly a thousand pounds. I had a bit of debt a while back but due to redundancy paid my creditors off. I have since sold my house due to divorce and now rent. I cannot afford this.

    Have you acknowledged the claim with intent to defend? You must do that asap!

      Thank you, I will get on that straight away. Do I write to Arrow or Santander...I am guessing Santander has "sold" whatever this is on?

        Hi GSDgirl & welcome to LB.

        Could this be a store card? (which may have 'transformed' into a credit card?)

        Imho, you should follow @Kati's informed opinion (Above), even though the PoC doesn't refer to the Consumer Credit Act or a regulated agreement..........they (AG/R) just mention a 'contract'.

          CCA request would go to the claimant (so Arrow Global)
          CPR to the claimants' solicitor (so Restons)

          In the CPR you can request anything that is mentioned in the PoC

          so it looks like you can ask for the "contract" and the "notice of assignment"

              Even the claim form is a bit weird, the coat of arms and the date stamp are really blurry and obviously photocopied.

                          I'm erring on the side of kosher. It seems legit as all on the moneyclaim site. I have submitted my intent to defend and thanks to you and Kati have drawn up the letters to both Arrow and Restons to put in the post tomorrow. Many thanks to both of you for your advice.                             The most important thing now is the court's timetable.
                            You have 33 days from the claim issue date to submit a defence. This might be extended, by agreement with the claimant, a further 28 days. If so, you (the defendant) will need to inform the court.

                              I went on the moneyclaim site and submitted a right to defend. The letters to Restons and Arrow will be in the post tomorrow. (the CCA and CPR) Is there anything else that I need to do now? xx
