Hi, Hopefully somebody can help me with this. I am currently self employed and co-own a business with one business partner (Who is also self employed). The "Business" is essentially nothing more than a name of the premises that we work from as both of us work on aself employed basis. Today my business partner (or co-worker) has received a letter addressed to her with details of an attachment of earnings order that has been issued against myself for around £300. I am yet to see the letter as I have not been in work today. Having spoken to her, she tells me that the letter mentions something relating to 'social security' and states that 'She' is legally bound to deduct money from my wages.
I am no legal expert but having done some research online this evening it would seem that firstly an attachment of earnings order cannot be made against a person whom is self employed, and secondly that I should have received some sort of correspondence relating to this prior to the order being made.
Until I see the letter myself I am unable to say what this relates to. However as far as I am aware I am up to date with all payments for loans, council tax, etc. The part that really baffles me is how and why my business partner has received this. She does not employ me, we are equal partners whom both work on a self employed basis, nor are we financially linked in anyway with regards to any debts.
Any advice would be hugely appreciated as it will be a few days before I am back on the premises to read the letter myself. My business partner has also gone away tonight for a week.
