            What do you want to do about the claim as Turkey is outside the EU at present the claimant cannot get a European Enforcement Order on the debt.

              If I have to I could go back to attend ...but I really can't at this point. What do you suggest is the best way forward.. I dident think it would get this far as court. 😔 X

                Dealing with Lowell is unpredictable to say the least.

                Options,

                Admit liability and pay.

                Make an offer of payment and ask for a consent (Tomlin) order which suspends the claim as long as agreed payments are maintain and no CCJ is registered. Draw back is miss just one payment or pay late Lowell will get judgement against you.

                Defend by post and put your defence in writing and the court will make judgement in your absence.

                Or ignore and let them get judgement which stays in public records /credit files for 6 years.

                  I note that your family (father and brother?) live at the address where the court papers have been sent which would include any subsequent enforcement action.

                  However, did I notice that you told the court you lived abroad so wouldn't be attending the hearing in your Directions Questionnaire?

                    Hi [MENTION=87380]Diana M[/MENTION] no i have no assests in the U.K. The house my letters are being sent to are my fathers address were I used to live. Yes I also told them in the questione and letter after the question air that I am unable to attend court. They offered a mediation but I declined due incerficant evidiance and I was unable to defend my case with the correct paper work I asked for.

                    For [MENTION=42011]Nem[/MENTION] would I be able to call instead asking for a consent (Tomlin) order which suspends the claim as long as agreed payments are maintain and no CCJ is registered instead of writting a letter.. But asking them to provide me with a email or letter of tomlin if they agree to my minimum payment on a monthly plan.

                        Telephoning leaves you without any proof of your offer and/or their reply.
                        You could try an e-mail suggesting the Tomlin Order to test the water.

                                I am unable to attend the dates given 24th January 2017 at the county court dartford.
                                And will I neither be able to attend any dates in the near future. As I have mentioned in the previous letters I no longer live in the uk.

                                I there for would like to resolve this situation by email or by letter to my fathers address.

                                I would like to make an offer of £10 a month of only the original amount of the debt it's self untill it's payed in full.
                                This is not including court fees or any other fees that have been applied without my knowledge.

                                This amount is the maximum I can pay as I am unable to work due to only holding a resident visa in the current country I am living.

                                I would also like to request a consent tomlin order to suspend the claim as long as agreed payments are maintained and no ccjs are registered against me.
