    Hi looking for some help please from all you wonderful people my partner received claim form (date issued was 21 June but due to beig away visiting family only got it last night) im dealing with it all and needs some help below are the details.

    Issue Date: 21 June 2016
    Amount approx: £17191.55
    Claimant: PRA Group
    Solicitor:
    Judge and Priestley LLP
    Original Creditor: Lloyds
    Particulars of Claim: Please type out in full excluding names/account numbers
    The claimant claims the sum of £16355.55 for debt + interest. On 01/01/1998 the defendant entered into an agreement with The Lloyds Banking Group for a credit card under reference ********. On 28/05/2012 the defendant defaulted on the agreement with an outstanding balance of £15819.15. On 24/11/15 the debt of £15639.15 was assigned to PRA Group (UK)Ltd. Notice of Assignment was sent to the defendant in accordance with s136 Law of Property Act 1925.
    AND THE CLAIMANT CLAIMS
    1.The sum of 15639.15
    2. Statutory interest pursuant to Section 69 of the County Courts Act 1984 at a rate of 8.00% per annum from 24/11/15 to 20/6/2016 £716.40, and thereafter at a daily rate of £3.43 until judgement or sooner payment

    Morning,

    Have you acknowledged the claim through MoneyClaim Online ? If not get that done soon as possible.

    Yes you need to send off the CPR letter and a CCA request.

    For the CPR request you can ask for the agreement, default notice and notice of assignment as they are all mentioned in the particulars of claim.

    So, first steps (within 14 days of receiving the claim)

    1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
    You'll need your claim reference and password from the front of the claim form - this will extend the time you have to respond to the claim to 28 days from when you received it

    2: Send A CCA REQUEST to the CLAIMANT ( see here )
    This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


    3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

    This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely) You can include a copy of your CCA request with this letter for information.



    As this is from 1998 it seems likely that documentation will be tricky for them to get together.

    Do you know if you had any PPI on the account at all ?
