    Hi I received a claim from hoist for an overdraft.
    acknowledged it,
    sent cpr request

    Am yet to hear anything from Cohens

    was issued on 21st April ,but got confused on timescales.

    Big problemo is I go on holiday in the morning,I had forgotten

    can I put in a defence and wing it? If so what,looked at templates but they refer to cca's?

    Did you put a CCA request in?? Most vital you do if you didn't

    What date did you do Acknowledgment of service?? 33 days as of that date to file your defence..

      Acknowledged on the 28th may
      Have not done a cca request,as I read cca does not cover overdrafts?

        Of course stupid me, still very new to this but you have 33 days as of 28th May

            21st April = date claim issued

            Take that date and add 33 days ( 28 days plus 5 for service ) gives you Result: Tuesday, 24 May 2016

            So get your defence in before you go anywhere. http://legalbeagles.info/forums/show...t-Court-Claims leave out the CCA parts but include the CPR bit.
