    OK the mediation service will refer the claim to your local court which will be in touch shortly with judged directions in regard to what happens next.

        All depends on what if anything the claimant has to back up the claim at present it seem unlikely that have anything.

          Ok got a court date for 5th december .. so far still nothing from claiments regarding papers work etc ... im really worried about court ..what do i take , say, do ? ... can they just produce all the paper work in court or would they have to send me it 1st ?

          Im still holding out for them not having anything which means the judge will rule against them right ? But i dont want to get to court and find they have all sorts of paper work ...(if that makes sence)

            Hello MM,

            Ok you will need to make a Witness Statement which must be served up the claimant and the court, together will all the " evidence " you have to support your defence, all documents must be copied and indexed a copy for you one for the claimant , one for the court index e.g. as

            Exhibit MM1 and so on.

            Yes Not Less than 14 days prior to the hearing.

            The Claimant Must do the same, if they turn up in court with documents not previously disclosed you can ask the judge to disallow them.

            We can help you through all of this right up to the court date.

              Thank you ... who do i get to do a witness statment and what should it say ? Lol

              I dont really have any evidence other than copys of the letters i sent to them asking for their proof and proof of postage ?

                You do your own witness statement MM unless you specified otherwise in your DQ and there are templates for you to get an idea on here...

                And your evidence is just that what you said the paper work received and sent by both parties along with with your defense makes up your overall case

                  You are the witness MM, it's your story of the events leading up to the issue of the claim,

                  Letters sent and received and results of CCA requests etc. any written evidence you have to support your defence, all documents must be indexed e.g. I sent a request on date exhibit mm1 etc.

                          OK very worried now ... iv waited to do my statement etc in the hope this would be dropped (not sure why I just hoped for a miracle)

                          So today I have copies of what BW have sent to court...it's their statement which is long lol it includes a cope of a credit agreement but it's just a blank copy ie no names or info ... they have a copy of the default letter they sent me and a copy of the account when it was sold to them and also a copy of some payments that where made to the account which stopped in 2012.

                          I will upload photos but I feel really sick now and I'm petrified of going to court
