  • Lowell Portfolio -County Court Business Centre.

    Hi first post and new to this and first court claim form ever received.
    Is this a genuine court claim or a 'composed ' one from Lowells?
    Says i owe £1991 to shop direct.Failed to maintain payments .Claiming £2150.28 ,court fee £105 and Legal rep costs £80.
    Feel sick receiving this as i have no paperwork for such amount.Had a debt with very a few years ago that agreed a repayment plan with them direct(it wasnt even over £600 let alone 2k) but since moved house and embarassed that i let it faze out when my income dropped when my daughter was born so this is first ive heard since.
    What should i do now as feel ill just looking at all the wording and trying to comprehend it.I could probably only afford to pay around £20 a month max to them now as had a huge drop in income.Any help would i would be very grateful for.

    As regards whether it's a genuine court claim, can you post up a copy of it? (suitably redacted to protect your personal info).

    What is the date of issue? (on the claim form).

    Have you had a look at the info at the top of this thread? (In green )

                      Issue date 06/05/2016, so I calculate (as things stand) defence to be filed in court before 4pm 08/06/2916.

                      (But check yourself using the checker at the top of the thread = issue date + 33 days)

                      The most important thing now is the court's schedule & any instructions given by it.

                      Acknowledge it asap (Instructions are given in claim pack).

                      MCOL is probably easiest.

                      Then comes the CCA & CPR requests.

                        Thank you.Going to sit down tomorrow morning once children are at school and work through the steps at top of the page.
                        Looking at the court forms.Looking at expenditure/income etc.If need to fill this in at some point would i need to put my husbands wage in and our joint expenditure as only child benefit goes in and out of my account and some small direct debits.Or is it just tied to me ?

                              Thank you.Do i need to tick dispute in full or part ? and one last question.On the CCA letter do i need to make the £1 postal order payable to Lowells or someone else? Dont want to make any mistakes.Many thanks for all help so far its much appreciated.

                              Defend Claim - within 28 days from Service (IF you acknowledged in time)

                              If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
