    Notice of Proposed Allocation to Small Claims Track - Holst portfolio

    I defended a claim by Holst and their solicitors Lowell for a 2013 credit card debt for £7,500. I sent them requests for copies of the agreement, statements of my account and letter of default and termination, none of which they supplied. I filled out the court papers and returned them stating I did not owe Holst any money and they had not supplied me with the documents as requested proving I did and therefore I did not recognise the claim. The claim was stayed for a month (until the end of April) Today I have received a Notice of proposed allocation to small claims track. Any advice would be welcome please

    Do you have proof of posting?

      i have proof of posting and requested cca and cpr. they returned my postal order saying they would request information. today i received a reconstituted copy of credit card t and cs. they are a general copy with no names dates signatures etc. but no copy of signed agreement.

        Re CCA request
        Did they send a statement of account?
        Are the T&Cs the same as at inception of the agreement?
        Any subsequent variations? (Apart from interest changes)
        Is the 'T&C' document also the agreement? (It doesn't need to be a signed copy; to comply with a CCA request, a reconstituted document suffices)

        Was the CPR request complied with?

          No statement of account received. The covering letter states that this is all that they require to provide to comply with CCA request. No response to CPR request. It is just a generic t and c document and as I don't have the original apart from the interest charges it may or may not be the same
