      Hi Nem
      1. The claim was discontinued by Catot.

      2. Robinson Way are acting on behalf of Cabot

      4. CCJ was applied over 6 years ago from bank, no other listing has ever been put on my credit report. I have just checked my credit report, there is nothing new listed.

      Many Thanks

Robinson Way are well known for going over the top when just acting as a collector for another company, so how often are they making contact and is it letters or phone calls?

I think we can safely tell RW/Cabot to go away to put it politely.

          Hi Nem
I am receiving at least 2 letters per week, they were calling me every day, I have now blocked their number on my phone, so they cant contact me by phone any more.
How should I word the correspondance to them please, should I do it via email, as they have said a representative will call after 5th September, which is Monday, I am terrified of them harrassing me and knocking on my door.
          Many Thanks

Lets try something along the lines of:

            Cabot
            Usual address.

            Date:

            Sir/madam.

I refer you to the County Court Claim No. .................................... issued by Cabot on date..............................and discontinued on date,,,,,,,,,,,,,,,,,,,,,,,.

I have now been contacted by your agent Robinson Way seeking payment for the alleged debt which was unenforceable in court as Cabot has not evidence of any sort to enable it to take further action.

There is no agreement and no evidence of earlier court action.

I now believe that the alleged debt is statute barred and I will not make any payments in regard to this alleged debt.
I now suggest you recall the files on this matter your agent Robinson Way Ltd. an cease all contact with me immediately.

Further contact from Cabot or it's agent will be considered to be harassment and suitable action will be taken.

Please take note that I will not discuss or communicate with any Field Operative representing your agent please ensure that this does not take place.

            Yours etc.

            Copy to RW.

If one of RW's oiks does arrive just tell him/her/it to leave your property immediately if they fail to leave call the police (999) and state you feel threatened by the person.

You don't have to open the door if possible tell the through a window.

                  Hello Flopf

I hope this works Cabot have tried on a number of occasions to heavily pursue debts in similar situations before making claims that debts without any evidence that any such debt exists.

Usually happens when they have seen a claim struck out or have to discontinue due to lack of proof.
The defence entered was strong and gave them no room to argue so some may consider the appointment of RW to pursue the debt is vexatious.
                  You Won !!

                  Good luck!!
